Welcome to Castify, a product of Castify ("we", "us", "our"). By downloading, installing, or using Castify (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Service Description

Castify is a desktop application that builds podcast feeds from third-party content sources such as YouTube, SoundCloud, and other supported platforms. Castify is a tool — we do not host, produce, or own any third-party content processed through the Service.

2. Eligibility

You must be at least 13 years old to use Castify. By using the Service, you represent that you meet this requirement.

3. User Accounts

You are responsible for maintaining the security of your account credentials.
You must provide accurate information when creating an account.
You are responsible for all activity that occurs under your account.
You must notify us promptly if you become aware of any unauthorized use of your account.

4. Acceptable Use

You agree to use Castify only for personal, non-commercial purposes. You may not:

Redistribute, resell, or publicly share content extracted through the Service.
Use the Service to infringe on the intellectual property rights of any third party.
Use automated tools to abuse, overload, or interfere with the Service.
Attempt to reverse-engineer, decompile, or extract the source code of the Service, except as permitted by applicable law.
Use the Service for any purpose that is illegal or prohibited by these Terms.

5. Content & Copyright

This is an important section — please read it carefully.

You are solely responsible for ensuring you have the legal right to access, extract, and convert any content you process through Castify.
Castify does not grant you any rights to third-party content. The Service is a tool; how you use it is your responsibility.
You must comply with the terms of service of any source platform you access through Castify, including but not limited to YouTube's Terms of Service and SoundCloud's Terms of Use.
We do not monitor, endorse, or verify the content processed through the Service.

DMCA & Copyright Complaints: We respect intellectual property rights. If you believe content associated with a Castify account infringes your copyright, please contact us at [email protected] with the following information:

A description of the copyrighted work you claim has been infringed.
The specific Castify feed URL or account involved.
Your contact information.
A statement that you have a good-faith belief that the use is not authorized.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We may remove content or terminate accounts of repeat infringers at our sole discretion.

6. Intellectual Property

Castify, including its design, code, branding, and documentation, is the property of Castify. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

7. Service Availability

The Service is provided on an "as is" and "as available" basis.
We do not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
Third-party platforms may change their services in ways that affect Castify's functionality. We are not responsible for such changes.

8. Limitation of Liability

To the maximum extent permitted by law:

Castify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.
We are not liable for any loss of data, content, or feeds resulting from service disruptions, account termination, or third-party platform changes.

9. Termination

You may stop using Castify and delete your account at any time.
We may suspend or terminate your account if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users.
Upon termination, your data (including feeds and episodes) may be permanently deleted.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of Castify after changes take effect constitutes your acceptance of the updated Terms.
